Legalization of Signatures

Notaries in Indonesia are mandated to perform legalization of signatures of documents. The parties sign the document in front of the Notary, and the Notary thereby witnesses the signing process while verifying the identities of the signatories. The document is deemed legal as of the date of signature. The Notary is not responsible for the content of the documents.

Registration of Documents (Waarmerking)

Agreements/documents signed in the absence of a Notary may be registered by a Notary at a later time, termed as Waarmerking. The document is legally effective as of the date of signing, not the date of registration. The Notary records the existence of the document, but verifies neither the content nor the identities of the signatories thereof.

Storage Deeds (Akta Penyimpanan)

In addition to having the signing of a document legalized by a Notary, the document may be turned into a Storage Deed, or Akta Penyimpanan, for safekeeping at the office of the Notary. The Notary is not responsible for the content of the document; however, a copy of the Storage Deed may be requested from the office of the Notary should the original document be lost or damaged.

Legalization of Documents for Overseas Use

Documents made and entered into in Indonesia may be used in other countries upon legalization by the receiving country’s embassy in Indonesia. Examples of documents whereby legalization may be required include:

  • Notarial Deeds
  • Powers of Attorney
  • Statutory Declarations (Statement Letters)
  • Contracts/Agreements

The process entails:

  1. Legalization of the document by a Notary Public in Indonesia at the time the document is signed
  2. Translation of the document into a language understood in the receiving country by a Sworn Translator
  3. Legalization of the signature and stamp of the Notary Public by the Ministry of Law and Human Rights of the Republic of Indonesia
  4. Legalization of the signature and stamp of the Ministry of Law and Human Rights official by the Ministry of Foreign Affairs
  5. Legalization by the embassy of the country where the document will be used
