Backgroud

Legal asset protection is crucial for any company, especially when it involves immovable assets such as land and property. This success story highlights how Putranto Alliance provided end-to-end legal support to a Jakarta-based company in retaining land ownership outside its domicile, specifically in Minahasa, North Sulawesi.

As the validity periods of three SHGBs approached expiration, our client needed to extend the validity period of its SHGBs to ensure continued legal ownership and asset protection. The company aimed to complete the extension process efficiently, without requiring physical presence in the region.

Our Role in Renewal of Building Use Rights

Putranto Alliance was appointed to provide comprehensive legal assistance in the renewal of all three SHGBs. Our involvement covered legal, administrative, and technical dimensions of the renewal process, including:

  • Coordinating the retrieval and preparation of corporate legal documents from Jakarta.
  • Drafting required notarial deeds and supporting documentation, complying with both national regulations and local land office requirements.
  • Facilitating all on-site procedures in Minahasa via our trusted Notary and Land Deed Official (Notaris/Pejabat Pembuat Akta Tanah or PPAT) network.
  • Identifying and resolving administrative issues, particularly mismatched records in the Land and Building Tax (Pajak Bumi dan Bangunan/PBB) data.
  • Managing the entire process through to the issuance of the electronic SHGB certificates with extended periods, ensuring a smooth legal outcome.

Challenges Faced

Several challenges emerged during the process:

  • The geographic separation between the company’s headquarters in Jakarta and the land’s location in Minahasa meant that all coordination had to be conducted remotely and cross-regionally.

  • An inconsistency in PBB data required resolution through a formal correction procedure prior to initiating the SHGB renewal process.

  • The need for continuous communication with the local land office and government authorities in Minahasa introduced jurisdictional and procedural complexities.

Solutions Implemented

To overcome these challenges, Putranto Alliance took a proactive and structured approach:

  • We facilitated the correction of the PBB data with the help of our local Notaris/PPAT partner, who had direct access to the relevant authorities and a deep understanding of local administrative procedures.
  • Our legal team provided end-to-end administrative support, ensuring all requirements were fulfilled in accordance with regulations.
  • Throughout the process, we maintained active monitoring and regular updates to the client, enabling transparency, progress tracking, and peace of mind.

Outcome and Impact

The project concluded successfully. All three SHGB certificates were extended on schedule, and the corrected land data was officially recorded.

Thanks to our strategic legal facilitation:

  • The client did not need to be physically present in Minahasa at any stage of the process.
  • Legal ownership of the land was securely extended for the next valid term, with all documents updated and accurate.
  • The client gained legal certainty and operational continuity, avoiding potential risks related to expired land rights.

Conclusion

This case illustrates how effective legal coordination, strong local partnerships, and precise project management can enable a smooth land rights renewal process, even across different regions.

Putranto Alliance is proud to have supported our client in securing their valuable assets without disruption. Through collaboration with trusted Notary and Land Deed Officials (Notaris/PPAT), we ensured that the entire procedure was efficient, timely, and legally sound, reaffirming our commitment to protecting our clients’ interests, wherever their assets may be.
