Preparing for the Expiry of Traditional Land Documents in Indonesia

After the 2nd of February 2026, traditional land proofs, such as girik, petok D, letter C, landrente, and similar documents, will no longer be recognized as valid title deeds. These documents serve only as administrative references, not legal proof of ownership. To secure land ownership rights, the land owner must obtain an official land certificate through the National Land Agency (Badan Pertanahan Nasional / BPN) before the deadline.

What Is the Expiry of Traditional Land Documents?

The End-of-Validity Notice signals that traditional land documents lose their legal force as title deeds five years after the enforcement of Government Regulation (Peraturan Pemerintah / PP) Number 18 Year 2021 concerning Management Rights, Land Rights, Residential Units, and Land Registration, which will be on 2 February 2026. After this date, traditional land documents cannot be used as proof of land ownership.

The affected traditional land documents are as follows:

  1. Girik
  2. Petok D
  3. Letter C
  4. Landrente (Petuk Pajak Bumi)
  5. Pipil
  6. Kekitir
  7. Verponding Indonesia

 

This change is mandated by:

  1. Government Regulation (Peraturan Pemerintah / PP) Number 18 Year 2021 concerning Management Rights, Land Rights, Residential Units, and Land Registration.
  2. Regulation of the Minister of Agrarian Affairs and Spatial Planning / Head of the National Land Agency (Peraturan Menteri Agraria dan Tata Ruang / Kepala Badan Pertanahan Nasional/ Permen ATR BPN) Number 16 Year 2021 concerning Third Amendment to Regulation of the Minister of Agrarian Affairs/Head of the National Land Agency Number 3 Year 1997 concerning Provisions for the Implementation of Government Regulation Number 24 Year 1997 concerning Land Registration.

 

The following certificates for land ownership status will replace the documents above:

  1. Right of Ownership Certificate (Sertifikat Hak Milik / SHM).
  2. Right to Build Certificate (Sertifikat Hak Guna Bangunan / SHGB).
  3. Right to Cultivate (Sertifikat Hak Guna Usaha / SHGU).
  4. Right to Use (Sertifikat Hak Pakai).
